Os pais de uma bebê de um ano que se negaram a vacinar a filha contra a covid-19 foram condenados pela Justiça ao pagamento de multa de R$ 20 mil em Jaguaruna. A decisão foi proferida na última quarta-feira, dia 28, após representação cível da 1ª Promotoria de Justiça da comarca.
A sentença aponta que, ao não vacinar a bebê por convicções pessoais, os responsáveis cometeram um ato infracional, contrariando a Nota Técnica n. 118/2023-CGICI/DPNI/SVSA/MS, que incorporou as vacinas contra a covid-19 no Calendário Nacional de Vacinação Infantil. A criança deve receber a primeira dose com seis meses, a segunda com sete meses e a terceira com nove meses.
O pedido de aplicação de multa feito pelo MPSC tem base no artigo 249 do Estatuto da Criança e do Adolescente (ECA), que tipifica como infração administrativa o ato de descumprir os deveres inerentes ao poder familiar, deixando de garantir aos filhos o direito à saúde. Em seu artigo 14, o ECA também estabelece como “obrigatória a vacinação das crianças nos casos recomendados pelas autoridades sanitárias”, como no caso do coronavírus.
Na situação específica, em abril, os pais se recusaram a deixar que a bebê fosse vacinada conforme a indicação dos profissionais em uma unidade de saúde da cidade. Na oportunidade, a mãe assinou um termo de responsabilidade confirmando a recusa, ciente de que a filha é do grupo prioritário para a imunização e de que estaria infringindo o ECA.
Após isso, em junho, os pais receberam uma notificação do Conselho Tutelar ressaltando a obrigatoriedade da vacinação e orientando a família a procurar a Secretaria de Saúde para regularizar a situação e apresentar, no prazo de 15 dias, a caderneta de vacinação atualizada ao Conselho.
Finalizado o prazo, os responsáveis não comprovaram a adoção das providências. Logo, o Conselho Tutelar acionou o Ministério Público, que levou a situação à Justiça.
Conforme a sentença, o valor da multa deverá ser destinado ao Fundo Municipal da Criança e do Adolescente de Jaguaruna.
Ações vêm sendo tomadas desde o início do ano na cidade
Em 6 de fevereiro, a 1ª Promotoria de Justiça de Jaguaruna instaurou um procedimento administrativo em função de o Município ter implementado, naquela época, políticas públicas contrárias à obrigatoriedade das vacinas do Calendário Nacional de Vacinação, incluindo a vacina contra a covid-19. Isso estaria ocorrendo em virtude do Decreto Municipal n. 7/2024, que dispensava a exigência de apresentação do comprovante da vacinação no ato da matrícula na rede pública de ensino.
Naquela oportunidade, a Promotora de Justiça Elizandra Sampaio Porto expediu uma recomendação tanto para a revogação do decreto quanto para a articulação entre integrantes do Conselho Tutelar, da Secretaria Municipal de Saúde e da Secretaria Municipal de Educação com o objetivo de dar amplo conhecimento à população acerca da imunização obrigatória. A finalidade, inicialmente, era sensibilizar os responsáveis legais da população infantojuvenil acerca da importância da vacinação.
Com o acatamento da recomendação, o decreto municipal foi revogado e integrantes do sistema de proteção a crianças e adolescentes promoveram articulações, estabelecendo um protocolo para o fluxo de atendimento em casos de recusas indevidas da vacinação, conforme indicado pelo Ministério Público. Desde então, os pais que se recusaram a imunizar os filhos têm assinado um termo de responsabilidade no qual declaram que estão infringindo o ECA e negando o direito constitucional da criança, com riscos à saúde caso ocorra o contágio por doenças evitáveis.
Após isso, o Conselho Tutelar de Jaguaruna faz contato com a família para buscar conscientizar acerca da importância da vacinação. Se houver uma nova recusa, a família recebe uma notificação escrita do Conselho Tutelar, na qual constam a obrigatoriedade da imunização e a orientação da necessidade de procurar a Vigilância Epidemiológica para regularizar a vacinação e apresentar, na sequência, a caderneta de vacina para o órgão no prazo de 15 dias úteis. Em caso de não cumprimento do prazo para imunização, o MPSC é notificado e tem ajuizado as representações cíveis.
